The State of Kansas has met Special Education Compliance Requirements of the State Performance Plan for data submitted in the February 1, 2022 Annual Performance Report.
The Individuals with Disabilities Education Act (IDEA) requires states to develop a State Performance Plan and Annual Performance Report (SPP/APR). This evaluates the State’s efforts to implement the requirements of IDEA and describe how the state will improve its special education programs. The SPP/APR include indicators that measure child and family outcomes, as well as other indicators that measure compliance with IDEA requirements.
The Kansas State Department of Education (KSDE) is currently developing the 2020 – 2025 SPP/APR. As a part of this process, KSDE requested stakeholder input on proposed targets for the SPP/APR indicators. This was an opportunity for KSDE to hear from educators, families, and community members on the direction our state takes to improve outcomes for students with disabilities.

The 2004 Amendments to the IDEA require each State to develop a State Performance Plan (SPP) and Annual Performance Report (APR) that evaluates the State’s efforts to implement the requirements and purposes of the IDEA, and describes how the State will improve its implementation. The Kansas State Department of Education is responsible for the Part B SPP/APR and it includes Indicators that measure child and family results, and other indicators that measure compliance with the requirements of the IDEA.
The IDEA also requires each State to report annually to the United States Department of Education (USDE) on its performance under the SPP. Specifically, the State must report in its APR, the progress it has made in meeting the measurable and rigorous targets established in its SPP. USDE is required to issue an annual determination to each State on its progress in meeting the requirements of the statute.
For the first time in 2014, and ongoing through 2020, USDE made Part B determinations using both compliance and results data, giving each equal weight in making a State’s determination.

Indicator 3 Fact Sheet (PDF)
Indicator 4A: Percent of districts that have a significant discrepancy in the rate of suspensions and expulsions of greater than 10 days in a school year for children with IEPs.
Indicator 4B: Percent of districts that have: (a) a significant discrepancy, by race or ethnicity, in the rate of suspensions and expulsions of greater than 10 days in a school year for children with IEPs; and (b) policies, procedures or practices that contribute to the significant discrepancy and do not comply with requirements relating to the development and implementation of IEPs, the use of positive behavioral interventions and supports, and procedural safeguards.
Indicator 4: Suspension and Expulsion (PDF)
Percent of children with IEPs from 5-Year-Old Kindergarteners through Age 21 served inside the regular class 80% or more of the day; inside the regular class less than 40% of the day; and in separate schools, residential facilities, or homebound/hospital placements.

Indicator 14 requires states to report the “percent of youth who are no longer in secondary school, had IEPs in effect at the time they left school, and were: A. Enrolled in higher education within one year of leaving high school. B. Enrolled in higher education or competitively employed within one year of leaving high school. C. Enrolled in higher education or in some other postsecondary education or training program; or competitively employed or in some other employment within one year of leaving high school”. (20 U.S.C. 1416(a)(3)(B)).

The SPP/APR includes comprehensive, ambitious, achievable, multiyear SSIP, with Phase I analysis, Phase II plan, Phase III implementation and evaluation, with stakeholder engagement in all phases, for improving results for children with disabilities. Previous years of SSIP progress are located within the full SPP APR report in the table at the beginning of this page.
